Repeat Offenses & Texas’s Lifetime Lookback

Texas applies a lifetime lookback when evaluating prior DWI convictions. There’s no time limit on how far back a prior conviction can be used to enhance a new charge under Texas Penal Code Section 49.09. A third or subsequent offense can result in a felony charge. Two prior convictions for intoxication-related driving offenses, or one prior conviction for intoxication manslaughter, can elevate a new DWI to a third-degree felony.

Intoxication Assault

When a driver causes serious bodily injury to another person while intoxicated, the charge becomes intoxication assault, a third-degree felony under Texas law. Penalties can increase further if the victim is a firefighter, EMS worker, peace officer, or judge on duty at the time of the incident.

Intoxication Manslaughter

If someone is killed, the charge escalates to intoxication manslaughter, a second-degree felony. A conviction can carry a fine of up to $10,000 and up to 20 years in prison.

DWI with a Child Passenger

A driver stopped on suspicion of intoxicated driving with a child under 15 in the vehicle faces a state jail felony, with a fine of up to $10,000 and up to two years of state jail time, separate from any child endangerment exposure.
